By accessing and using Fyronethra's aerial yoga and circus fitness services, website, or facilities, you agree to be bound by these Terms of Use and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing our services.

AERIAL YOGA AND CIRCUS FITNESS INVOLVE INHERENT RISKS INCLUDING SERIOUS INJURY OR DEATH. BY PARTICIPATING, YOU ASSUME ALL RISKS AND WAIVE CERTAIN LEGAL RIGHTS.

2. Aerial Yoga & Circus Fitness Specific Risks
🪂 Unique Aerial Practice Risks
Aerial yoga and circus fitness activities involve specific risks including but not limited to:
- Falls from height - Risk of falling from suspended hammocks or equipment
- Inversion injuries - Blood pressure changes, dizziness, disorientation
- Equipment failure - Potential hammock, rigging, or anchor point failure
- Spinal compression/decompression - Risks to neck, back, and spine
- Circulation issues - Restricted blood flow during wraps and poses
- Claustrophobia/panic - Psychological distress when wrapped or inverted
- Fabric burns/marks - Friction injuries from hammock material
- Joint stress - Unusual pressure on shoulders, wrists, ankles
3. Health Requirements and Restrictions
3.1 Medical Clearance Required
You must obtain medical clearance before participating if you have any of the following conditions:
- Pregnancy (any stage)
- High or low blood pressure
- Heart conditions or cardiovascular disease
- Spinal injuries or chronic back problems
- Neck injuries or cervical spine issues
- Recent surgeries (within 6 months)
- Glaucoma or other eye conditions
- Inner ear problems or vertigo
- Bone density issues or osteoporosis
- Blood clotting disorders
3.2 Absolute Contraindications
🚨 DO NOT PARTICIPATE if you have:
- Uncontrolled high blood pressure (180/110 or higher)
- Recent concussion or head injury
- Acute spinal injury or severe back pain
- Active herniated disc with symptoms
- Recent eye surgery or retinal problems
- Severe claustrophobia or anxiety disorders
- Active eating disorders with medical complications
- Intoxication from alcohol or drugs
4. Weight and Equipment Limitations
For safety reasons, our aerial equipment has the following restrictions:
- Maximum weight limit: 120kg (265 lbs) per person
- Dynamic loading: Weight limits may be lower during dynamic movements
- Shared equipment: Combined weight restrictions apply for partner work
- Equipment inspection: All rigging is inspected before each class
5. Liability Waiver and Release

5.1 Assumption of Risk
I acknowledge that aerial yoga and circus fitness activities are inherently dangerous and involve risks of serious bodily injury, including permanent disability, paralysis, and death.
5.2 Release of Claims
I voluntarily assume all risks and hereby release, waive, discharge, and covenant not to sue Fyronethra, its owners, instructors, employees, and affiliated persons from any and all liability, claims, demands, or causes of action arising from my participation.
5.3 Indemnification
I agree to indemnify and hold harmless Fyronethra from any loss or liability incurred from my participation in activities.
5.4 Medical Treatment Authorization
I authorize Fyronethra to obtain emergency medical treatment for me and acknowledge that I am solely responsible for all medical expenses.
6. Safety Rules and Conduct
6.1 Mandatory Safety Requirements
- Arrive early: Minimum 15 minutes before class for safety briefing
- Proper attire: Form-fitting clothing, no jewelry, bare feet or grip socks
- Health disclosure: Inform instructor of any health conditions or injuries
- Follow instructions: Never attempt moves without instructor approval
- Respect equipment: No unauthorized adjustments to rigging or equipment
- Stay hydrated: Bring water and take breaks as needed
- Communicate discomfort: Immediately report pain or difficulty
6.2 Prohibited Behaviors
- Participating under the influence of alcohol or drugs
- Eating large meals within 2 hours of class
- Attempting unsupervised or unauthorized moves
- Using equipment without proper instruction
- Ignoring instructor safety guidelines
- Disturbing other participants or being disruptive
- Recording video or taking photos without permission

In case of injury or emergency:
- Remain calm and do not move injured person
- Alert instructor immediately
- Call emergency services if needed (000)
- Contact emergency contact person
- Complete incident report
7. Booking and Cancellation Policies
7.1 Class Bookings
- Advance booking required: All classes must be pre-booked
- Capacity limits: Maximum 8 students per aerial class for safety
- Age restrictions: Minimum age 12 years (parental consent required for minors)
- Experience levels: Beginners must start with foundation classes
7.2 Cancellation and Refund Policy
- Student cancellations: 24-hour notice required for full credit
- Late cancellations: 50% credit for 2-24 hour notice
- No-shows: No credit or refund
- Studio cancellations: Full credit or refund provided
- Weather cancellations: Classes moved indoors or rescheduled
- Medical reasons: Credits available with medical certificate
8. Pregnancy and Aerial Yoga
🤰 Special Pregnancy Considerations
Pregnant students must:
- Obtain written medical clearance from healthcare provider
- Inform instructor of pregnancy stage at each class
- Avoid all inversions and deep backbends
- Avoid poses lying on back after first trimester
- Listen to their body and modify or stop as needed
- Consider prenatal-specific classes when available
Note: We recommend consulting with a prenatal yoga specialist before beginning aerial practice during pregnancy.
9. Intellectual Property
All content, including but not limited to:
- Class sequences and choreography
- Training materials and manuals
- Video content and photography
- Website content and design
- Fyronethra branding and logos
Are the exclusive property of Fyronethra and protected by copyright law. Unauthorized reproduction or distribution is prohibited.
10. Photography and Social Media
- Studio photography: We may photograph classes for promotional use
- Opt-out option: Students can decline to be photographed
- Social media: Tag us @fyronethra in your aerial photos!
- Privacy respect: No photos of other students without permission
- Professional shots: Available upon request for additional fee
11. Payment Terms
- Payment methods: Cash, card, or online payment accepted
- Class packages: Valid for 6 months from purchase date
- Membership fees: Non-refundable and non-transferable
- Late payments: May result in suspension of services
- Price changes: 30-day notice for existing members
12. Facility Rules
- Personal belongings: Studio not responsible for lost or stolen items
- Cleanliness: Help maintain clean practice space
- Respect: Maintain quiet environment for practice
- Mobile phones: Silent mode during classes
- Food and drink: Water only in practice areas
- Shoes: Remove before entering practice space
13. Instructor Qualifications and Authority
Our instructors are:
- Certified in aerial yoga and circus arts
- Trained in first aid and emergency procedures
- Experienced in modifications for different abilities
- Authorized to stop participation for safety reasons
- Required to maintain professional boundaries
14. Termination of Services
Fyronethra reserves the right to terminate or suspend services for:
- Violation of safety rules or conduct policies
- Failure to pay fees or charges
- Inappropriate behavior toward staff or students
- Providing false health or medical information
- Participation while under medical restrictions
15. Insurance and Medical Coverage
Important: Fyronethra's insurance does not cover individual participant injuries. You are strongly advised to maintain your own:
- Health and medical insurance
- Personal accident coverage
- Income protection insurance
16. Governing Law and Jurisdiction
These terms are governed by the laws of New South Wales, Australia. Any disputes will be resolved in the courts of New South Wales.
17. Severability
If any provision of these terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
18. Modifications to Terms
Fyronethra reserves the right to modify these terms at any time. Changes will be posted on our website and take effect immediately. Continued participation constitutes acceptance of modified terms.
